A judge sentences defendants. Sentencing is in the sole discretion of the judge. In some cases, a jury may recommend a sentence but it is always up to the judge whether the convicted defendant gets that sentence. A judge may sentence a person anywhere within the range of punishments outlined by law but never higher than a jury’s recommendation.
