Every defendant, whether charged with speeding or murder, is presumed innocent unless proven guilty. In Missouri, the State must prove the charges beyond a reasonable doubt. If the State does not prove its case beyond a reasonable doubt then the defendant goes free. The State does not have a right to appeal a finding of fact by the fact finder. If the trial is by jury, then all 12 jurors must agree as to the verdict (either guilty or not guilty).
